Terms of Use
Last updated
These terms govern your use of canaanct.com.my. They are not the terms on which we deliver services: those live in the engagement agreement signed between Canaan and a client, and where the two differ, the engagement agreement prevails.
Who we are
Canaan Communication & Technologies Sdn. Bhd., registered in Malaysia with the Companies Commission of Malaysia (SSM) under registration number 201601004144 (formerly 1175070H), of C-20-6, KL Trillion, 338 Jalan Tun Razak, 50400 Kampung Datuk Keramat, Kuala Lumpur, Malaysia. In these terms, “we”, “us” and “Canaan” mean that company; “you” means whoever is using this website.
Using this site
You are welcome to read, quote and share what is published here. You may not use this website to break the law, to interfere with its operation or security, to extract data by automated means at a scale that degrades it for others, or to send us anything designed to cause harm.
Some parts of this site are for signed-in Canaan staff. Attempting to reach them without authorisation is not permitted.
Information on this site is not an offer
This is the clause worth reading twice, because it is the one most likely to matter to you.
Nothing on this website is a contractual commitment, a quotation, or an offer capable of acceptance. Service descriptions explain how we run the work in general terms; scope, service levels, staffing and price are set for each engagement in a written proposal and then in the engagement agreement. If something here matters to your decision, ask us to put it in the proposal — an operations lead would rather answer during evaluation than negotiate afterwards.
We take care that what we publish is accurate at the time of publication, and we publish figures with the basis they were measured on. We do not warrant that everything remains current, and we may change any of it without notice. Where a figure or a claim on this site is material to you, ask for the underlying evidence: certificates, policy documents and reference calls are provided to parties evaluating us, on request and under a non-disclosure agreement where you want one.
What belongs to whom
The content of this website — text, layout, graphics, diagrams, photography and code — belongs to Canaan or is used with permission, and the Canaan name and mark are ours. You may quote from the site with attribution and a link. You may not republish substantial parts of it, or present it as your own.
Casework published here is anonymised unless the client has given written permission to be named. Client names, marks and materials referred to in that work remain their owners’.
Getting in touch through this site
When you submit the proposal form or subscribe to Insights, you are asking us to contact you, and we handle what you send under our Privacy Notice. Please do not send confidential or sensitive information through a web form — including personal data belonging to your own customers. If your inquiry needs that, tell us and we will agree a secure route and, where appropriate, a non-disclosure agreement first.
Links to other sites
Where we link to another organisation’s site, we do so because it is useful, not as an endorsement. We do not control those sites and are not responsible for their content or their handling of your data.
Availability
We aim to keep this website available and correct, but it is a marketing website: we do not guarantee that it will be uninterrupted or error-free, and we may change, suspend or withdraw any part of it. Service levels for delivered work are a separate matter and are agreed in the engagement agreement.
Liability
To the extent permitted by Malaysian law, we are not liable for loss arising from your use of, or reliance on, this website — including any decision taken on the basis of information published here rather than agreed in writing with us. Nothing in these terms excludes liability that cannot lawfully be excluded.
[TO CONFIRM: this clause is drafted conservatively and must be reviewed by Canaan’s legal adviser. A limitation-of-liability clause is the single passage on this site most likely to be tested, and the wording should be theirs rather than ours.]
Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute arising from them.
[TO CONFIRM: whether Malaysian jurisdiction is the right choice for website terms given that Canaan also operates in Uzbekistan, and whether any dispute-resolution step should precede litigation.]
Changes to these terms
We may update these terms. The date shown at the top of this page is the date of the current version, and using the site after a change means the updated terms apply.
